Resumo
Trata-se de breve estudo a respeito da parte geral do Código Penal brasileiro de 1830, com ênfase em fatores que indicam a seletividade do sistema de justiça criminal do império. Sobretudo em uma sociedade tão economicamente desigual como a brasileira, é relevante entender as origens históricas de determinados institutos, até mesmo para evitar, ainda que sob outras roupagens, a perpetuação dessa seletividade penal. Tentou-se apresentar algo das influências legislativas e doutrinárias estrangeiras que sofreu a parte geral do Código imperial e as suas relações com o ambiente político de então. Também se mostrou como se dava na prática a aplicação desse Código. Concluiu-se que alguns dos princípios e garantias liberais, como a legalidade, a culpabilidade e a vedação de penas cruéis, embora importantes, não eram respeitados, especialmente no que toca aos crimes envolvendo escravos e insurretos.

Abstract
This paper approaches the General Part of the 1830 Brazilian Penal Code, with an emphasis on factors that indicate the selectivity of the imperial criminal justice system. In a society as economically unequal as Brazil, it is particularly important to understand the historical origins of certain institutions, in order to avoid, albeit from different approaches, the perpetuation of the criminal selectivity. We have attempted some examples of foreign legislative and doctrinal influences that affected the General Part of the Code and its connections with the political environment of that time. In addition, we have sought to show how the practical application of the Code worked then. Our conclusion was that some of the liberal principles and guarantees such as legality, culpability and the prevention against cruel punishment, although important, were not respected, particularly with regard to crimes involving slaves and insurgents.
