Resumo
O artigo apresenta os contornos a respeito da humanidade em torno do cárcere no Brasil. Em um primeiro momento, estuda o surgimento do debate acerca da humanização da prisão. A seguir, mostra o aparecimento da discussão no Brasil e o desenvolvimento das práticas punitivas durante o século XIX. O estudo analisa o casamento entre o discurso médico e a prisão no fim do século XIX e no início do XX, a instalação de instituições preocupadas com modelos de interpretação da questão racial e o fortalecimento dos ideais de neutralização dos perigosos. Os séculos XX e XXI receberam o incremento de instrumentos normativos nacionais e internacionais de proteção da dignidade humana. Testemunham, porém, a constante violação dos direitos fundamentais das pessoas presas. Essas dinâmicas e persistências históricas da desumanidade são o objetivo de análise deste trabalho.

Abstract
The article presents the contours of humanity in Brazilian prisons. We first discuss the emergence of the debate about the humanization of prisons. Next, we show when the discussions started in the country and how the punitive practices developed during the 19th century. We further analyze the relation between medical discourses and prisons in the late 19th and early 20th centuries; the installation of institutions concerned with models of interpretation of racial issues and the strengthening of the ideals of neutralizing dangerous individuals. The 20th and 21th centuries have seen an increase of national and international normative instruments of protection of the human dignity. However, constant violation of the fundamental rights of prisoners is still rampant. The article focuses on this dynamics and on the ongoing history of inhumane prisoner treatment.
