Resumo
No início do século XX, eclode um pensamento que constitui a verdadeira antítese do pacifismo.
A Grande Guerra exerceu um profundo impac- to nos escritores alemães, que se dedicaram a
redigir panegíricos de propaganda e de elogios àquela que deveria ser “a guerra para acabar com todas as guerras”. Inserido numa época de transformações, Rui Barbosa interpreta as grandes questões internacionais a partir de uma intensa reação a tais escritores. Poucos sabem, porém, é que sua reação aos escritores alemães acontece por intermédio de idiossincrasias e de
apropriações conceituais, especialmente de au- tores franceses, que o ajudam, por meio da lei- tura de suas obras e das práticas de apropriação,
a formular a sua própria reflexão sobre os acon- tecimentos. Esses autores, como serão identifi- cados, ajudam-no a estudar os fundamentos da
guerra e a compreender muito bem que ele con- frontava um inimigo sem rosto, uma ideia, um
pensamento. Uma ideia tão perigosa, que havia engendrado a maior guerra que a humanidade já havia visto e que ameaçava acabar com toda a civilização. O presente artigo pretende revelar este inimigo, bem como apresentar o itinerário
de sua identificação por parte do jurista brasilei- ro. Apresenta também um itinerário que começa
na Haia (1907) e passa, posteriormente, a algu- mas práticas de apropriação intelectual com as
quais o autor compreende o perfil do seu antago- nista para sair, então, em defesa irrestrita do Di- reito e de uma ideia de jurisdição internacional.

Abstract
At the beginning of the 20th century, there emerges a thought that constitutes the very antithesis of pacifism. The Great War had a profound impact on German writers who devoted themselves to writing propaganda pamphlets praising that which was supposed to be “the war to end all wars.” Living in a time of transformation with a number of uncertainties leading to a worldwide outbreak, Rui Barbosa interprets the great international issues of the time and reacts intensely to such writers. However, few are aware that the root of his reaction goes back to idiosyncrasies and concepts he took over from important French authors who helped him build his own reflections on the events. We identify these authors in the paper, since they were paramount to help Rui Barbosa study the foundations of war and realize that he was confronting a faceless enemy, an idea, a thought. It was so dangerous an idea that it had triggered the greatest war that humanity had ever witnessed and was threating to destroy civilization. The article intends to reveal this enemy, as well as the path that led the Brazilian lawyer to identify it. A path that begins at The Hague (1907) and leads to appropriation of knowledge by means of which the author identifies the enemy so that he could finally stand firmly in defense of the rule of law and of the idea of international jurisdiction.
