Resumo: O artigo a seguir investiga o Humanismo Peni- tenciário no nascedouro europeu ocidental, isto é, tal como era discutido pelos intelectuais do Velho Mundo a partir de fins do século XVIII. Para tanto, foram analisadas sob um prisma discursivo as obras clássicas (Dos delitos e das penas e The state of the prisons in England and Wales) de dois grandes nomes daquele univer- so: Cesare Beccaria (organizou as bases para pensar novas engrenagens de um sistema pu- nitivo que fosse marcado pela racionalidade) e John Howard (pioneiro em pensar a respeito de condições prisionais humanizadas). Em se- guida, buscou-se debater como esse ideário foi interpretado e rearticulado pelos juristas brasi- leiros, bem como os meios mediante os quais esses últimos converteram a temática descrita em reflexões visando possíveis alterações junto à realidade prisional do país.

Abstract: The following article is part of the doctoral thesis defended by the author at the Postgraduate History Program at UFMG. Before discussing the topic, it was necessary to investigate how intellectuals in the European old world understood and discussed prison humanism at the end of the 18th century. For this purpose, we analyzed the classical works of two authors who are references in the area, namely Cesare Beccaria and John Howard. The former laid in his book Crime and Punishment the basis for a new penal system that was marked by rationality; and the latter was a pioneer in advocating for humane prison conditions in his book The State of the Prisons in England and Wales. We then discuss how their ideas were interpreted and discussed by Brazilian lawyers as well as the thoughts and reflections they had aiming at eventual changes in the country’s prison reality.
